Chapter 8: Right and Responsibility Section 9.1: General Right and Responsibility

(A)

The people of the Republic have the following right and responsibility

1. The right to migrate to and to live in any part of the Republic

2. The right to freedom of religion

3. The right of public gathering

4. The right to live, to work and to own property

5. The right to file civil suit

6. The right to vote.

7. The responsibility to pay tax

8. The responsibility to serve in compulsory military service.

9. The right and responsibility to receive education.

But the right listed above should exclude action that cause harm to peace, harmony or justice

(B)

To prevent any conduct that would cause harm to peace, harmony or justice

The right listed above should exclude

1. Individuals that have been found guilty of conducting a criminal offense, unless he has been pardon for such offense.

2. Organizations who are known or suspected to be of a criminal organization or terrorist organization and individuals who are known or suspect to be a member of such organization

(C)

Subject to the rules above, with the exception of

1. To prevent a person from affecting the freedom of another

2. To prevent a person from causing harm to another

3. During emergency

4. During martial law

5. Maintain social order

6. Maintain peace and harmony

7. To deal with threats to the Republic or the international community

8. Or to serve public interest,

No legislation can interfere with such right of a citizen of the Republic.

(D)

This constitution does not recognize gambling debt to be legitimate debt one person can own to another, thus, a person has the right not to pay gambling debt, if it is to his pleasure and should receive no negative consequences, as a result and if he chooses to pay such gambling debt, he should pay it by part or by all, at a time of his pleasure and receive no negative consequence, as a result and legislation should protect such right of a person.

(H) 

This constitution does not recognize any contract that dictate for a person to perform sexual service or perform an act that is in violation of a legislation of the Republic to be legitimate.

(This is not part of the constitution proposal, which is why it is written in a different color.) Unlike the constitution of most country, the current constitution of Australia does not include any guarantee of basic human right, allowing events such as stolen generation to take place. Currently, all human right of Australia, is out of ethic of members of parliament, but they can just as well create legislation such as “Killing a gay man is legal, if it is to act according to such teaching of the bible.” And even make a further law that say “Only those who are member of a particular political party are allow to vote in an election” currently, this is how the Communist Party hold dictatorship in China, according to the constitution of the People Republic of China, the country is a democracy, much like the United States, but without constitution clause that guarantee voting right of all citizens, the Communist created law to only allow selected people that is authorized by the Communist Party to vote in election and run for Parliament and President.
